In addition to our “reactive” services, we offer consulting for information governance and preventive measures that target at minimizing potential damage if an incident occurs.
eDiscovery refers to the identification, collection, preparation, review, presentation and production of electronically stored information (ESI), e.g. in connection with the preparation of legal proceedings or disputes. Unstructured data is thereby indexed and structured, so that it can be reviewed and analysed in an investigation. Typically this affects emails and so-called “loose” files which include text, spread sheets, presentations and other user files. In the eDiscovery process the relevant data is normalized and presented in a unified format i.e. on a special review-platform. This facilitates analysis and assures that relevant contents can be identified more effectively.
Our service ranges from identifying all relevant data sources to the production of case relevant data to our clients.
Today nearly all business administrative processes are IT based and managed electronically. Therefore the collection of several hundred gigabytes or terabytes may become necessary. Apart from the technical handling of such enormous data volumes we ensure that data protection aspects are being thoroughly considered, in order to prevent any breach of personality rights or the disclosure of business relevant data.
Especially in disputes at court the legal usability of digital evidence is one of the most important aspects. In order to ensure that the data is not disputable in court, data needs to be collected and documented in a forensically and legally sound manner. To do so every step and all data is documented and verified.
What is the factual starting point? What are we looking for? What shall and should not be shown to the opposing party? etc. All these examples are important questions to attain a qualitatively good result. Reviewer or consultant training on these systems is of utmost relevance, in order to ensure that information can be found, analysed and correctly interpreted.
Considering todays’ complex regulatory and legal guidelines, many companies are confronted with various challenges regarding the storing of emails and other company data. Due to the lack of appropriate tools and know-how, these challenges are often handled rather poorly. The companies also face the task of implementing strategies which reduce the ever-growing volume of data, whereby complying with the given data retention regulations.
The most common approaches are to backup, archive and journal data and implementing Document Management Systems. Nevertheless, with the rapidly increasing data volume, control over important data is easily lost. Only few companies know exactly what data they possess and where it is stored. Data that cannot be located or is not accounted for is useless and may contain risky information, which can be harmful for the company. In this context, the term “Dark Data” is often uses. Dark Data is data which is neither clearly defined or nor locatable. Data can turn “dark” by simply saving it in the wrong location.
The continuous data growth adds additional complexity to these approaches and makes them also bare challenges for data protection. How effectively is your data protected against internal and external threats? Who has access to which data? What preventive and detective measures are implemented? Currently only few companies are properly dealing with this matter. But current economic and political events show that companies of any size can be affected by it. Confidential and sensitive data such as employee, client and financial information or research and development results, etc. have to be protected from unauthorized access. All of this data is a fundamental part of your business value. With the appropriate tools, Swiss FTS can help you to identify these weaknesses and bring light into darkness.
